ISRAEL KHAN SC, a member of the Commission of Inquiry into Udecott and the construction industry, slammed Udecott for issuing a pre-action protocol letter on July 24 which threatened the members of the commission with legal action if they did not step down on the basis of apparent bias.

Khan’s condemnation comes on the heels of Udecott’s decision earlier this week not to pursue legal action against the commission.

In a letter delivered by hand on Wednesday to Edward Collier, an attorney at the firm Pollonais, Blanc, de la Bastide and Jacelon (which is representing Udecott in the inquiry), Khan slammed the company for accusing the members of the commission with bias, and threatening them with legal action. Khan also dismissed claims that he had allegedly made disparaging remarks about certain persons in a television interview as false.

He said Udecott reversed its decision to take legal action against the commission when it realised its error.

He was now calling for a public apology from Udecott and its lawyers. Khan added that the inquiry is one of the most important in the country’s history and will complete the task which it has been mandated to undertake.

The commission will resume its hearings next month and is expected to submit its final report to President George Maxwell Richards in November.
